Oak Wash has The Cottonwood Ditch Association that controls, among other things, property owners use of ditch water. This declaration is to advise buyers of the existence of the Association as well as to advise any buyer that a survey may be needed to determine the exact parcel borders and corners. The City of Cottonwood indicated that some portion of the parcel by the "Oak Wash" may be in a flood plain. This may also be a subject of a survey which can be completed as a contingency prior to close of escrow. My conversation with the City of Cottonwood indicated that surrounding properties were C2 commercial zoning and that C2 zoning could likely be applied to this parcel. They indicated a building plan should be submitted prior to actions towards rezoning. The City of Cottonwood also mentioned C1 and C2 zonings as a possibility if someone wanted to build housing either on owned or leased land. Seller is willing to cooperate with a developer to get a project approved and a zoning change prior to close of escrow provided plans are professionally designed and workable in its execution in the opinion of the seller.
Seller will assist and cooperate in advancement of buyers plans prior to close of escrow. Survey and zoning changes may be part of the buyers inspection period, and are to be at buyers expense unless negotiated otherwise.
